DUI Criminal Court Process Timeline*
Initially, a DUI citation is issued and possibly an arrest. A client may
bond out or may be released on their own recognizance (ROR). A court
date is written on your ticket. You will need to attend, unless your
attorney advises you differently.
The first court date is called an Arraignment. At this hearing, a plea
is entered (Guilty or Not Guilty). The court will determine if you have
an attorney. Our clients are excused from this Arraignment, provided the
proper paperwork is filed and docketed with the Clerk of Courts. Hamilton Law Services will have filed paperwork indicating that your plea is NOT GUILTY and we are your attorney of record.
Always check with your attorney to see if you need to attend a
particular court date. At the Arraignment, a pretrial date will be
scheduled within approximately 30 days.
By the first pretrial date Hamilton Law Services will receive
“Discovery” from the State Attorney’s Office (the Prosecutor). Discovery
includes the police reports and witness list in your case. It is the
evidence that the State plans to use against you.
Once we get the discovery, we will order the DUI video. This process
takes approximately two weeks. We typically ask for another 30 day
continuance
at the first pretrial hearing.
Before the second pretrial conference, a Hamilton Law Services Attorney
will sit down in our office to review the reports and video with you. We
will come up with our strategy at this time.
At the second pretrial conference, We may set a new hearing date for a
motion to suppress if necessary. We may set a new date to give the State
time to review the case for a reduction. The State may agree to a
Reckless Driving plea agreement, or we may decide that the case needs to
be set for Trial. Most cases are resolved in approximately 4-6 months,
depending on each specific situation
It is a good Idea to hire an local attorney based in the County where
your charges are filed. This can help you in many ways. Your attorney
may be familiar with the county Judges as well as the prosecutor.
Although many transactions can be done by email or fax these days,
there is no substitution for doing business in person. A successful
